Description:
The TD Five Bob Bike Tour is the world's largest charitable bike ride, 40-miles of traffic-free NYC. We rely on a small army of more than 2,000 volunteers to ensure that our riders have to the best experience possible on the Tour. Become a course marshal and bring your bike! Volunteers on the course ensure riders are safe by assisting with traffic flow and spotting road hazards, fixing flats and keeping the energy high.

Additional Info:
Volunteers under 18 must be accompanied by an adult. All volunteers must be able to ride 40 miles by bicycle and attend a virtual orientation. Volunteers are expected to pick up their riding kit on the morning of the Tour.

Acknowledgment, Waiver, Release, Indemnification, and Agreement

In consideration of the acceptance of my (or, if applicable, my Child's) application for participation as a volunteer in the 2026 TD Five Boro Bike Tour on Sunday, May 3, 2026 (together with all events, riding, programs, transportation, preparation, and follow-up activities before, during, after, and in connection therewith, the "Tour") by Bike New York, Inc. ("Bike New York"), I, the undersigned, agree to the following (and, if applicable, agree to the following on behalf of my Child):
Acknowledgment and Assumption of Risks Involved in Participation. I (and, if applicable, I on behalf of my Child) acknowledge that the Tour contains risks, including but not limited to the risks of falling, collision with other bicyclists, bicycles, motor vehicles, pedestrians, stationary or moving objects, surface hazards, including pot holes and gratings, the conditions of the road or practice surface, equipment failure, inadequate or misused safety equipment, the use of equipment provided by the Tour or others, weather conditions, exposure to Infectious Diseases, including COVID-19, my (or, if applicable, my Child's) negligence and the negligence of others. I (and, if applicable, I on behalf
of my Child) fully realize and accept that as a result of my (or if applicable, my Child's) participation in the Tour, I (and if applicable, I on behalf of my Child) may sustain severe and permanent physical or mental injury, property damage, financial loss or other damages. I (and, if applicable, I on behalf of my Child) willingly, expressly and unconditionally assume all such risks and dangers associated with my (or if applicable, my Child's) participation, whether known or unknown, seen or unforeseen. My (or, if applicable, my Child's) participation is voluntary and done at my (or, if applicable, my Child's) own risk. I (and, if applicable, I on behalf of my Child) voluntarily assume all risks of loss, damage, death, or injury that may be sustained by me (or, if applicable, my Child) while participating in the Tour or directly related to or incidental to the Tour and any activity associated therewith.

I (and, if applicable, I on behalf of my Child) attest that I am (and, if applicable, my Child is) sufficiently trained for participation and completion of the Tour and in excellent health with no mental, physical, or medical conditions which would impair, prevent, or prohibit me (or, if applicable, my Child) from safely participating in the Tour. I (and, if applicable, I on behalf of my Child) recognize that an event of this nature can be physically demanding. I (and, if applicable, I on behalf of my Child) acknowledge Bike New York's recommendation that I (or, if applicable, my Child) consult with a physician regarding the advisability of participation in this activity. I (and, if applicable, I on behalf of my Child) agree to not be under the influence of alcohol or any illicit or prescription drugs which would in any way impair ability to participate in the Tour. I (and, if applicable, I on behalf of my Child) acknowledge that serious accidents occasionally occur during the Tour, and that participants in this Tour may sustain mortal or serious injury as a consequence thereof. I (and, if applicable, I on behalf of my Child) acknowledge that situations may arise during the Tour which may be beyond the immediate control of the Tour organizers. Nevertheless, I (and, if applicable, I on behalf of my Child) agree to assume these risks.

Equipment and Helmets. Unless Bike New York otherwise provides, I am responsible for providing a bicycle for use in the Tour (for myself, or, if applicable, for my Child) and for ensuring that such bicycle is in good mechanical condition. I (and, if applicable, I on behalf of my Child) agree to examine any bicycle and determine that it is suitable for use by me, by my Child or by another participant before use, taking into account the height, weight, and fitness of the user and ensure that it is of good mechanical condition. I (and, if applicable, my Child) attest that any equipment (including bicycles) that I (and, if applicable, my Child) will use during the Tour is in good mechanical condition. I (and, if applicable, I on behalf of my Child) acknowledge that bicycle helmets may (but do not always) prevent serious injury, and I agree that I (or, if applicable, my Child) will wear a bicycle helmet while participating in the Tour.

Infectious Diseases. I (and, if applicable, I on behalf of my Child) acknowledge that: participation in the Tour includes possible exposure to and illness from infectious and/or communicable diseases, including but not limited to MRSA, influenza, and coronavirus (“COVID-19”) (collectively, "Infectious Diseases"). I (and, if applicable, I on behalf of my Child) am responsible for making decisions about the best prevention and treatment for myself (or, if applicable, my Child) with respect to preventing and treating Infectious Diseases, but I agree to take steps that are at least as rigorous as those required or recommended by all applicable city, state, and federal governmental authorities, and as otherwise
required by Bike New York. The circumstances regarding Infectious Diseases change frequently, and it is my responsibility (not that of Bike New York or any Releasee) to inform myself (or, if applicable, my Child) of the latest news, risk, and local, state, and federal guidelines (including those promulgated by the State of New York (see https://health.ny.gov/) and the Centers for Disease Control and Prevention ("CDC") (see https://www.cdc.gov/).

Release and Waiver. I (and, if applicable, I on behalf of my Child) hereby unconditionally RELEASE, WAIVE, and AGREE NOT TO SUE Bike New York, the City of New York, The New York City Department of Transportation, the City of New York Police Department, the Metropolitan Transportation Authority, TD Bank, N.A., Portage Worldwide, Inc., and all other sponsoring or participating entities, governmental agencies, businesses and organizations, and their respective subsidiaries, affiliates, parent companies, and all past, present and future directors, trustees, officers, employees, agents, volunteers, contractors and representatives of the foregoing (collectively, "Releasees", and each individually, "Releasee"), from all liability and all claims of any kind - including but not limited to for damages, death, personal injury or loss of property, loss of work, loss of wages, trauma, emotional distress, or medical expenses - resulting from, arising out of, or connected in any way with, in whole or in part, my (or, if applicable, my Child's) participation in the Tour, WHETHER CAUSED BY NEGLIGENCE OF THE RELEASEES OR OTHERS, to the maximum extent permitted by law. In addition, I (and, if applicable, I on behalf of my Child) waive my (and, if applicable, my Child's) insurers' right to make a claim against Releasees based on payments by insurers to me (and, if applicable, my Child and/or on my Child's behalf) for any reason. I (and, if applicable, I on behalf of my Child) acknowledge this means my insurers have no rights of subrogation against the Releasees. I (and, if applicable, I on behalf of my Child) agree to not initiate, participate in, or assist anyone in connection with, any claim, lawsuit, court action or other legal proceeding or demand, whether currently known or unknown, whether anticipated or unanticipated, against Releasees, in connection with the Tour, and I (and, if applicable, I on behalf of my Child) waive any right I (and, if applicable, my Child) may have to do so.

Indemnification. Without limiting the effectiveness in any way of the waivers, releases, and assumptions of risk in this document, I (and, if applicable, I on behalf of my Child) agree to indemnify, hold harmless and reimburse Releasees and their representatives and agents from and for all damages, losses, costs, or expenses (including legal fees) incurred by Releasees or paid by them to any person (including me or my insurers (and, if applicable, my Child or my Child's insurers)) in respect of any accident, injury (including death), loss, or property damage, however caused, resulting from, arising out of, or otherwise in connection with my (or, if applicable, my Child's) participation in the Tour.

Governing Law. All matters arising out of or relating to this Waiver and Release shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any choice or conflict of law provision or rule (whether of the State of New York or any other jurisdiction).

Medical Treatment and Records. I (and, if applicable, I on behalf of my Child) acknowledge and agree that medical or other services rendered to me (or, if applicable, my Child) by or at the insistence or recommendation of any of the Releasees is not an admission of liability or obligation to provide such services or an agreement to continue to provide any such services, and is not a waiver by any Releasee of any rights. I (and, if applicable, I on behalf of my Child) consent to emergency medical treatment and transportation as medical professionals may deem appropriate in the event I (or, if applicable, my Child) suffers an injury arising out of participation in the Tour. This Waiver and Release
extends to any liability arising out of or in any way connected with the medical treatment or transportation provided in the event of such injury. I (and, if applicable, I on behalf of my Child) further acknowledge that if I am (or, if applicable, my Child is) injured I am responsible for my (or, if applicable, my Child's) medical expenses.

The Rules of the Tour. I (and, if applicable, I on behalf of my Child) agree I (or, if applicable, my Child) will abide by the rules of the Tour, including those established by Bike New York (including, without limitation, that I (or, if applicable, my Child) will ride in the street, ride with traffic and in a straight line, obey traffic laws, signal as required, wear a helmet and refrain from wearing headphones). I (and, if applicable, I on behalf of my Child) agree I (or, if applicable, my Child) will obey the directions of the Bike New York Ride marshals and NYPD Bike Officers and other officials. I (and, if applicable, I on behalf of my Child) agree I (or, if applicable, my Child) will wear the official rider ID kit. I agree to wear the Bike New York vest/bib/bike plate to identify myself as a registered volunteer. Bike New York reserves the right to reject any entry and to disqualify and bar or remove any individual from the Tour. Reasons for this include but are not limited to: a violation of the rules of the Tour, unsafe conduct, abusive behavior, participating without an official volunteer vest, rider bib, bike plate or helmet cover; participating with an official volunteer vest, rider bib, bike plate or helmet cover assigned to another person; transferring or attempting to transfer an official volunteer vest, rider bib, bike plate or helmet cover or to obtain such items from another person, and providing false information on the Tour entry form(s) or to the Tour at any time including during the registration process. I acknowledge (and, if applicable, I on behalf of my Child), acknowledge that individuals disqualified from the Tour may be barred from future Tours and other Bike New York events.

Changes and Cancellations. I (and, if applicable, I on behalf of my Child) hereby agree that changes in the COVID-19 situation, in weather, in government recommendations or directives, in other conditions involving the Tour may cause Bike New York to cancel, suspend, postpone or terminate the Tour, and acknowledge that Bike New York will have no liability to me (or, if applicable, my Child) in the event of any cancellation, suspension, postponement or termination of the Tour.

Intellectual Property Rights. I (and, if applicable, I on behalf of my Child) hereby irrevocably grant full permission to Bike New York, TD Bank, N.A., all other sponsoring or participating entities, and each of their affiliates and subsidiaries (collectively, "Authorized Users") to use photographs, videotapes, motion pictures, sound recordings or any other recordings of this Tour, that include my (or, if applicable, my Child's) name, likeness and/or voice, for legal promotional activity or any other legitimate purpose, in each case without compensation to me (and, if applicable, my Child), and I (and, if applicable, I on behalf of my Child) further irrevocably grant the Authorized Users full permission to perpetually use, edit, reproduce, transmit, distribute, publish, display, and/or perform, in whole or in part and without the need for paying a royalty or other compensation, any of those photographs, videotapes, motion pictures, sound, or any other recordings of the Tour that include my (or, if applicable, my Child's) name, likeness, voice, statements, and general biographical information (e.g., residence city and state or province) (collectively, "Authorized Materials"), singularly or in conjunction with other photographs, videotapes, motion pictures, sound recordings or other recordings (whether from the Tour or otherwise), for advertising, publicity, commercial, or any other business purposes without limitation as to time, territory or medium. I (and, if applicable, I on behalf of my Child) hereby waive all rights to review or approve the use of the Authorized Material and I (and, if applicable, I on behalf of my Child) hereby release the Authorized Users from any and all claims and demands arising out of their use of the Authorized Materials, including claims for defamation, violation of rights of privacy or publicity, intrusion, false light, public disclosure of private facts, physical or emotional injury or distress, or any similar claim or cause of action, in tort, contract or otherwise, now or hereafter known in any jurisdiction throughout the world. I (and, if applicable, I on behalf of my Child) represent and warrant that the rights granted to and use of the Authorized Materials as contemplated hereunder do not, and will not, violate any right of, or conflict with or breach any contract with, any person or entity. Further, I (and, if applicable, I on behalf of my Child) hereby consent to the sharing of any of my (and, if applicable, my Child’s) personal information by Bike New York with its service providers (including, but not limited to, event/class registration platforms, payment processors, donation processors, email servicing providers, administration software providers, event management providers, web analytics partners, and search engine optimization and marketing partners) who perform administrative and technology functions on behalf of Bike New York.

Severability. Should any portion of this Waiver and Release be judicially determined invalid, voidable, or unenforceable for any reason, such portion shall be severable from the remaining portions, and such invalidity, voidability or unenforceability shall not affect the validity, effect, enforceability, or the interpretation of the remaining provisions of this Waiver and Release.

Consent and Release of Participant (or, if applicable, Parent or Legal Guardian). I (and, if applicable, I on behalf of my Child) consent to this Waiver and Release and agree that its terms shall bind me (and, if applicable, my Child and any other parent or legal guardian of my Child) and my (and, if applicable, my Child's and any other parent or legal guardian of my Child's) heirs, executors, administrators, legal representatives, and assignees. I (and, if applicable, I on behalf of my Child) acknowledge that this is an important legal document in which I (and, if applicable, I on behalf of my Child and any other parent or legal guardian of my Child) give up legal rights and remedies I (and, if applicable, my Child and any other parent or legal guardian of my Child) would otherwise have and this document applies to all activities at the Tour, regardless of whether specifically listed above or not. I hereby state that I am authorized to make this decision (and, if applicable, make this decision on behalf of my Child and any other parent or legal guardian of my Child).

I (and, if applicable, I on behalf of my Child) hereby warrant that I (and, if applicable, I on behalf of my Child) have read and understand this Waiver and Release carefully, completely understand its terms and conditions, acknowledge that I (and, if applicable, I on behalf of my Child) intend for my signature to serve as confirmation of my (and, if applicable, my Child's) complete and unconditional acceptance of these terms, conditions and provisions. I warrant that I am at least eighteen (18) years of age or older if I am signing on behalf of myself.
Participant Acknowledgements:
•	Bike New York COVID vaccination policy: Vaccination is recommended but not mandatory for participation in the Tour.
•	Bike New York will comply with all city, state, and federal health guidelines (which may change at any point up to the Tour) to maximize safety for all participants, volunteers, and staff. I agree to respect all guidelines in place during the event, including (as applicable) the wearing of masks, social distancing requirements, vaccination requirements, and practicing preventive hygiene.
•	Bike New York may request that participants, volunteers and their guests wear face masks at certain points before, during, and/or after the Tour. I acknowledge and agree to comply with any mask-related request made by Bike New York in connection with my participation in the Tour.

VOLUNTEER POLICY AND CODES OF CONDUCT (the "Policy")
I agree (and, if applicable, agree to the following on behalf of my Child):
•	To treat participants, community partners, fellow volunteers and Bike New York staff with respect and courtes
•	To show up on time and dress appropriately for the volunteer opportunity. (This information will be relayed to the volunteer in advance by Bike New York)
•	To serve to the best of my ability, and in a respectful, professional, and cooperative manner while at a class or event.
•	To register in advance for a volunteer opportunity using Let’s Do This or other method as directed by Bike New York.
•	To notify Bike New York, if I am no longer able to volunteer at any time.
•	That if I am riding a bicycle during my volunteer opportunity that:
-	My bicycle is in working condition
-	I am wearing a helmet
-	I practice safe riding at all times
•	That while representing Bike New York, I will not engage in the following:
-	Discriminatory or racist statements or behaviors
-	Sexual harassment, for example, jokes, innuendos, insults, sexist remarks, and the display of derogatory or pornographic pictures, leering, touching, or kissing
-	The use of any alcohol or illegal drugs
-	Any unlawful or inappropriate activity

In addition, I agree to not use my participation in Bike New York volunteer opportunities to promote partisan politics, religious matters, or other affiliations outside of Bike New York.

Working with Minors. I acknowledge that Bike New York is committed to providing a safe environment for minors. As a volunteer working with minors on Bike New York's behalf, I agree that I will be held to the highest standards of conduct, including, but not limited, to the following:
•	I will treat minors with respect at all times, regardless of their race, color, national origin, ancestry, religion, disability, medical condition, sex, gender identity, or sexual orientation.
•	I will maintain appropriate physical boundaries at all times, and touch children – when necessary – only in ways that are appropriate, public, and non-sexual. If touching is required, I agree that it must be for a class related purpose (example: helmet fitting). I agree that I will always ask permission before approaching a minor.
•	If one-on-one interaction is required, I agree that it will take place in an open, well-illuminated space where I am observable by other volunteers or program staff.
•	I agree that I will not engage in private communications with minors (text messaging, e-mail, phone, internet chat, on-line games or other forms of social media).
•	I agree that I will not meet with minors outside of established program locations or outside of established times.
•	I agree that I will not provide transportation to minors unless doing so is an acknowledged component of the program. When transporting minors, I agree that more than one volunteer or program Staff member must be present in the vehicle.
Photography Policy. I agree that I am prohibited from posting photos of Bike New York class and program participants on my personal or other social media accounts. I acknowledge and agree that only Bike New York has the permission to post a photo/video of a participant from Bike New York's accounts. I acknowledge that any photos taken may be submitted to the Bike New York Communications Department for review and publication. I acknowledge that I am allowed to share or share or re-post via any social media platform(s) any photo that Bike New York has posted in any of their social media accounts.

I acknowledge that as an exception to the above paragraph, I am permitted to post photos/videos that I take at Bike Expo New York, the TD Five Boro Bike Tour, Discover Hudson Valley, and Twin Lights Ride. I agree to always ask and receive permission before taking or posting someone's photo/video.

Sexual Harassment Policy. I acknowledge that Bike New York is committed to maintaining a workplace free from sexual harassment. I acknowledge that harassment is a form of workplace discrimination. I agree to work in a manner that prevents sexual harassment in the workplace. I acknowledge that this Policy is one component of Bike New York's commitment to a discrimination-free work environment. I acknowledge that sexual harassment is against the law and all employees have a legal right to a workplace free from sexual harassment and I understand that I am urged to report sexual harassment by filing a complaint internally with Bike New York. I understand that I can also file a complaint with a government agency or in court under federal, state or local anti-discrimination laws.
