Description:
The Hoag OC Marathon would not be possible without the support of over 2,000 volunteers that assist throughout the event weekend. We will host and support approximately 135 schools (10,000 kids) for our Hoag Kids Run the OC, another 15,000 runners in the Full and Half Marathons, and the Hoag OC 5K! Since our inception, The OC Marathon and related events have raised and helped our partners raise over $5 million in charitable funds.

Waiver

ACKNOWLEDGMENT, AGREEMENT, RELEASE AND WAIVER OF LIABILITY

ALL VOLUNTEERS IN THE OC MARATHON AND RELATED EVENTS (“EVENT”) ARE REQUIRED TO, AND HEREBY DO, ASSUME ALL RISK OF VOLUNTEERING/PARTICIPATION IN THE EVENT BY SIGNING THIS GENERAL RELEASE AGREEMENT.

The undersigned volunteer (“volunteer”) on behalf of himself/herself and on behalf of volunteer’s personal representatives, assigns, heirs, executors, and successors hereby fully and forever releases, waives, discharges and covenants not to sue The OC Marathon LLC, The OC Marathon Foundation, the City of Newport Beach, the City of Costa Mesa, the City of Irvine, the City of Santa Ana, OC Fair & Event Center, Orange County Department of Education, South Coast Plaza, San Diego County Credit Union, any or all of the sponsors, charities or schools affiliated with the OC Marathon, all municipal agencies whose property and/or personnel are used or in any way assist and all other sponsoring or co-sponsoring companies, organizations or individuals related to the Event, and the directors, officers, affiliates, employees, representatives, volunteers, sponsors, agents or other relations to such (collectively, the “Releasees”) from any and all liability to the Volunteer and his/her personal representatives, assigns, heirs, executors, and successors for any and all loss(es) or damage(s) and any and all claims or demands therefore, on account of injury to the Volunteer or property or resulting in the death of the Volunteer, whether caused by the active or passive negligence of all or any of the Releasees or otherwise, in connection with the Volunteer's participation in the Event.

The Volunteer represents and warrants that he/she is in good physical condition and is able to safely participate in the Event. The Volunteer is fully aware of the risks and hazards inherent in participating in the Event, and the Volunteer voluntarily assumes these risks.

By signing this waiver, Participant/Volunteer acknowledges the contagious nature of the novel coronavirus (COVID-19) and voluntarily assumes the risk that s/he by attending and or participating in the Event, and that exposure or infection may result in illness, permanent disability or death. Further, Participant/Volunteer acknowledges that the risk of being exposed to COVID-19 at the Event may result from acts, omissions or negligence of Participants and others, including, but not limited to other Volunteers or any Releasee. Participant/Volunteers knowingly and voluntarily agrees to comply with and adhere to any and all necessary and required COVID-19-related safety and risk mitigation practices during Participant/Volunteer’s attendance and participation in the Event. Such practices may include, but are not limited to, temperature checks, maintaining social distancing, wearing of a mask or face covering, and washing hands and/or using hand sanitizer frequently. Participant/Volunteer agrees to comply with changes to CDC Guidelines as necessary. Participant/Volunteer acknowledges that s/he will not be able to participate if they are shown to have a fever of 100.4 or higher. In addition, Participant/Volunteer agrees that s/he will not attend or participate in the Event if they are currently experiencing any symptoms of COVID-19 or have been in recent contact with a person with COVID-19 (or experiencing any known symptoms).

The Volunteer hereby grants full permission to any and all of the foregoing to use his/her name, voice, and/or picture without compensation or notice in any broadcast, telecast, advertising, promotion or other account of this event for any purposes whatsoever.  The Volunteer acknowledges that providing his/her email address on the entry form entitles The OC Marathon LLC to email him/her regarding related topics.

The Volunteer hereby grants to the medical director of the Event, and their agents, affiliates and designees access to all medical records (and physicians) as necessary and authorizes medical treatment as needed.  In the event that medical treatment is required, the Volunteer agrees to allow the medical professionals to release information to The OC Marathon LLC and its employees, agents or representatives regarding such treatment.  The Volunteer warrants that all statements made herein are true and correct and understands that Releases have relied on them in allowing Volunteer to participate in the Event.  I HAVE READ THIS WAIVER AND RELEASE, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN VOLUNTARILY.

IF VOLUNTEER IS UNDER AGE 18: The parent/guardian certifies that my son/daughter has my permission to volunteer in the Event.  The parent/guardian has read the forgoing RELEASE AND WAIVER OF LIABILITY AGREEMENT and by accepting the waiver intentionally and voluntarily agrees to its terms and conditions.  The parent/guardian further certifies that my son/daughter is in good physical condition and is able to safely volunteer in the Event.  The parent/guardian authorizes medical treatment for my son/daughter as needed and grants access to my child's medical records as necessary.
