In exchange for the opportunity for me and/or my child(ren)/ward(s) listed herein, if applicable, to participate in the THRIVE CITY 5K on Sunday, April 6, 2024 (the “Event(s)”) held at Thrive City located at 1 Warriors Way, San Francisco, CA 94158 (the “Premises”), I, for myself and on behalf of my child(ren)/ward(s), if applicable, my/their heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE, INDEMNIFY AND HOLD HARMLESS GSW Arena LLC, Golden State Warriors, LLC, Golden State Group LLC, Golden State Valkyries LLC, Golden State Community Foundation (together, “GSW”), the National Basketball Association and its Member Teams, NBA Properties, Inc., JPMorgan Chase Bank, N.A., Kaiser Foundation Health Plan, Inc., RunSignup, Inc, Mascot Sports, Inc., the owners and lessors of the premises on which the Event(s) is/are occurring, and the respective parents, subsidiaries, affiliates, directors, officers, governors, employees, sponsors, service providers, subcontractors, vendors, and a gents of each of the foregoing (the “Indemnified Parties”) FROM AND AGAINST ANY AND ALL INJURY, DISABILITY, DEATH, loss, damage to person or property, claims, causes of action, or demands relating to or arising out of the Event(s) and/or my and/or my child(ren)’s/ward(s)’s, if applicable, participation in the Event(s), WHETHER ARISING FROM NEGLIGENCE OF THE INDEMNIFIED PARTIES OR OTHERWISE, to the fullest extent permitted by law. I acknowledge the risk of injury to me and/or my child(ren)/ward(s), if applicable, from the activities involved in the Event(s) is significant, and includes the potential for permanent disability and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist. I, FOR MYSELF AND ON BEHALF OF MY CHILD(REN)/WARD(S), IF APPLICABLE, MY/THEIR HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES, AND NEXT OF KIN, KNOWINGLY AND EXPRESSLY ASSUME SUCH RISKS, both known and unknown, HOWSOEVER CAUSED OR ARISING AND WHETHER BY NEGLIGENCE OF THE INDEMNIFIED PARTIES OR OTHERWISE and accept personal responsibility for the damages following such injury, permanent disability or death. On behalf of myself and/or my child(ren)/ward(s), if applicable, I expressly waive any and all rights that I, we, and/or they may have under California Civil Code Section 1542 (or any other statute or rule of similar import, intent, or effect) which states: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY. I, ON BEHALF OF MYSELF AND THE CHILD/WARD LISTED BELOW, VOLUNTARILY ASSUME ALL RISK AND DANGER OF PERSONAL INJURY (INCLUDING DEATH) SICKNESS (INCLUDING ILLNESS, LONG-TERM ADVERSE HEALTH CONDITIONS, AND OTHER RISKS OF EXPOSURE TO COMMUNICABLE DISEASE OR ILLNESS, OR A BACTERIA, VIRUS, OR OTHER PATHOGEN CAPABLE OF CAUSING A COMMUNICABLE DISEASE OR ILLNESS), LOST, STOLEN, DAMAGED OR CONFISCATED PROPERTY, AND ALL OTHER HAZARDS ARISING FROM, OR RELATED IN ANY WAY TO, THE PROGRAM, WHETHER OCCURRING PRIOR TO, DURING OR AFTER THE PROGRAM, HOWEVER CAUSED, AND WHETHER BY NEGLIGENCE OR OTHERWISE. In an emergency, I grant permission to representatives of GSW to have the authority, at my expense, to utilize the most convenient volunteer rescue squad vehicle or ambulance to transport me and/or my child(ren)/ward(s), if applicable, to the hospital, and if necessary, I authorize medical treatment for myself and/or my child(ren)/ward(s), if applicable. If the Event takes place on any basketball court, I understand and agree that I shall not have any right to bring and shall not bring, or cause or allow to be brought, any materials or props that may damage the basketball court, or that will require clean-up, including but not limited to powders, glitters, liquids, heeled or dark soled shoes, and sharp or metal objects. I grant full permission to the Indemnified Parties to use, and to grant third parties the right to use, without further notification, authorization or compensation to me and/or my child(ren)/ward(s), or anyone on my, their and/or our behalf, my and/or my child(ren)’s/ward(s)’s, if applicable, name and likeness, as well as any photographs, audio, videotapes, motion pictures, recordings, or other record of my and/or the child(ren)’s/ward(s)’s, if applicable, participation in the Event(s) (or any excerpt thereof) in any and all media, whether now known or hereafter to become known or developed, throughout the universe, and in perpetuity, and I represent and warrant that no further permission is required for the Indemnified Parties and their designees to use my and/or my child(ren)’s/ward(s)’s, if applicable, participation in the Event(s) as provided, or otherwise exercise the rights granted herein. I understand and agree that, in connection with the Event(s), I and/or my child(ren)/ward(s), if applicable, may acquire information that is identified as “confidential” or that, given the nature of the information and the circumstances regarding its disclosure, should reasonably be understood to be confidential, and I and/or my child(ren)/ward(s), if applicable, shall not disclose any such information to any third party. If I am providing volunteer services or otherwise assisting with the operation of the Event(s), I hereby acknowledge that I am not an employee of GSW, and thereby not entitled to any compensation, health insurance, retirement plans, workers’ compensation insurance, or any other benefits offered by GSW to its employees and GSW will not be liable for any of the foregoing, even if it is later determined by a court of competent jurisdiction that I and/or my child(ren)/ward(s) listed herein have or had the status of employee of GSW in relation to my/their/our volunteer services provided for the Event(s). I hereby represent and warrant that I have full authority to execute this General Release of Liability and Assumption of Risk (the “General Release”) on behalf of myself and/or my child(ren)/ward(s), if applicable. If any portion of this General Release is found to be unenforceable or invalid, that portion shall be severed, and the remainder shall remain in full force and effect. I also represent that I am eighteen (18) years of age or older and, if applicable, am the parent or legal guardian of the minor(s) participating in the Event(s). I HAVE READ THIS GENERAL RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND FULLY UNDERSTAND THE TERMS AND UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY ACCEPTING IT AND ACCEPT IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.BY CLICKING TO ACCEPT THE TERMS AND CONDITIONS HEREIN, I AM EXECUTING THIS GENERAL RELEASE WITH THE FULL FORCE AND EFFECT AS WOULD APPLY TO A SIGNATURE AND I AGREE ON BEHALF OF MYSELF AND/OR MY CHILD(REN)/WARD(S) LISTED HEREIN TO BE LEGALLY BOUND BY THE TERMS AND CONDITIONS OF THIS GENERAL RELEASE. In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees. I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition. In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization. As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: [3]https://www.cdc.gov. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race. Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes. This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice.
